Soybean moratorium: STF will resume judgment on MT law

The Supreme Federal Court (STF) will resume, in the virtual plenary, between October 24 and November 3, the judgment of the Direct Action of Unconstitutionality (ADI) 7,774, which questions the constitutionality of Law 12,709/2024 of Mato Grosso. The norm discussed prohibits the granting of fiscal benefits and the donation of public land to companies that are signatories of commercial agreements, such as the soybean moratorium. Minister Luís Roberto Barroso canceled the request for prominence that he had made on October 9, returning the case to the virtual format. The score is 4 to 1 for the partial unconstitutionality of the law. The rapporteur Flávio Dino voted to reinstate the article that prohibits fiscal benefits only from January 1, 2026, accompanied by Alexandre de Moraes, Gilmar Mendes, and Edson Fachin (with reservations).
