The 3rd Criminal Division of the Daejeon High Court (Chief Judge Kim Byeong-sik) announced on the 2nd that it overturned the six-year prison sentence and 100 million won fine imposed on A for violating the Act on the Indication of the Origin of Agricultural, Forestry, and Fishery Products, and instead sentenced A to three years in prison and a 50 million won fine.
The fine imposed on the corporation was also reduced from 100 million won to 50 million won.
A was put on trial for allegedly making chili powder from Chinese crushed seasoning (also known as dadaegi) and chili powder and seeds between October 2021 and May 2022, and advertising it as if it was made from high-quality chilies grown by domestic farmers, selling a total of 3,615 kg (worth 57.8 million won) of chili powder.
About 1 ton of it was supplied as a food ingredient for school meals.
In 2020, A was also sentenced to two years in prison, suspended for five years, and a 10 million won fine for deceiving the origin of Chinese sweet potato starch as domestic and selling it.
The first trial court set a higher sentence than the prosecutor's demand, stating that the impact and damage to society were severe as it was supplied to school meals, directly affecting students' health, and sold in large quantities to an unspecified number of individual consumers.
The fact that A applied for bail after being indicted and released on bail, and then fled on the day of sentencing, was also considered.
The appellate court stated that "the defendant confessed to all the crimes and the damage to the companies that received the chili powder has been virtually recovered" and "considering that the defendant has made efforts to recover the damage and reflect, such as donating 20 million won to a scholarship foundation in the region where the meal ingredients were supplied, the sentence of the lower court is heavy," and accepted the defendant's argument.
