The New Civil Liberties Alliance (NCLA), a civil rights law firm, has filed a lawsuit against the Washington Department of Fish and Wildlife (WDFW) on behalf of crabbers over a new electronic monitoring program for Dungeness crab fishing vessels. The program, set to begin in 2024, requires vessels to have state-approved electronic monitoring devices, which the NCLA argues allows the department to track vessels constantly, even for personal use. The suit, filed in Washington Superior Court, argues that the program is unconstitutional and infringes on privacy rights without a warrant. The NCLA has successfully challenged similar federal GPS monitoring rules for fishermen in the past and anticipates a similar outcome in this case.
