On April 30, 2025, the Court of Justice delivered a judgment in Case C-386/23 (Novel Nutriology). The subject of the dispute was the possibility of using health claims related to botanical substances (so-called botanicals) in the advertising of a dietary supplement offered for sale by the company Novel Nutriology. The issue of legal regulations in the field of food labeling and promotion has been of interest to the European Union legislature for several decades. Similar to Poland, most Member States do not have detailed national regulations concerning the sale of supplements through means of communication at a distance. The applicable EU food law and the supplementary national legislation, which provide the basis for food control, also apply in the case of this type of sale.
