Despite the Prince Edward Island Potato Board's arguments that the decision was unreasonable due to a lack of evidence, both the Federal Court and the Appeal Court found the order to be reasonable, with the Appeal Court confirming the lower court's application of the correct reasonableness standard and supporting the minister's view of the province's 'infestation' based on the detection of the fungus 35 times in P.E.I. since 2000.
